Explicit Consent Notice

This notice covers the two situations where Turkish law (KVKK Art. 5 and 9) requires your separate, explicit consent, because our other legal grounds (contract performance, legal obligation, legitimate interest) are not sufficient on their own. Ticking either box below is never a condition for registering or using the Platform — each is separate and optional.

1. Explicit Consent to International Data Transfer

Some features you may choose to use (e.g., AI-assisted image/text generation, campaign suggestions, the chat assistant) technically run through AI service providers (such as Anthropic and Google) whose servers are located outside Türkiye, mainly in the United States. When you choose to use such a feature, the relevant data (e.g., your product image/text, or the content of your query) is transferred to these providers, only for the purpose of performing the action you requested, and within the transfer safeguards required by KVKK Art. 9.

In the exceptional cases where such a transfer does not rely on an adequate country or a recognized safeguard mechanism (standard contract, undertaking, etc.), we will separately and explicitly ask for your consent the first time you use that feature. If you decline, only that specific AI-assisted feature will be unavailable to you; every other part of the Platform is unaffected.

2. Explicit Consent to Commercial Electronic Messages / Marketing

If you tick the box below, you give explicit consent, under Turkey's Electronic Commerce Law No. 6563, to receive commercial electronic messages (email and/or SMS) about new Platform features, campaigns and offers.

You can withdraw this consent at any time, using the "unsubscribe" link in any message we send, or by writing to info@babbagedigital.com; withdrawal does not affect the lawfulness of anything done before it.

3. Withdrawing Consent

Under KVKK Art. 11, you may withdraw any explicit consent you have given, at any time and without giving a reason, using the contact methods described in Section 10 of our Privacy Notice. Withdrawal only has effect going forward.
